1. Agreement to Terms
By placing an order or using this website , www.featherstoneflorals.com (the “Site”), you (“Customer”, “you”, “your”) agree to be bound by these Terms and Conditions (the “Terms”).
If you do not agree to these Terms, please do not use the Site or place any orders.
2. Definitions
FeatherStone Florals (“we”, “us”, “our”) refers to the owner/operator of this Site.
“Products” means the goods, items or services offered for sale on this Site.
“Order” means your purchase order for Products placed via the Site.
3. Orders and Payment
- All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or description, or suspicion of fraud.
- You agree to provide accurate, current, and complete billing, shipping and contact information.
- Payment must be made at the time of purchase. We accept payment methods as described at checkout. You authorize us (or our payment processor) to charge your chosen payment method for the total order amount.
- Prices, product availability, and shipping charges are subject to change without notice until your order is placed and payment is confirmed.
4. Shipping & Delivery
We will ship your Product(s) using the shipping method you select at checkout.
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather, or other factors beyond our control.
Risk of loss and title for items you purchase pass to you upon our delivery to the carrier.
5. 30-Day Exchange Policy (No Refunds)
To ensure clarity and fairness, the following policy applies to all Products purchased on this Site:
- Exchange Only – No Refunds: We do not offer refunds under any circumstances. Instead, we offer a 100% exchange within 30 days of the date you receive the Product (“Exchange Period”).
- To be eligible for exchange: the Product must be unused, in its original condition, and with all original tags, packaging and labels intact. Any item showing signs of wear, damage, or alteration will not be eligible for exchange.
- To initiate an exchange, you must contact us at featherstoneflorals@gmail.com within 30 days of delivery, including your order number and reason for exchange. We will provide further instructions (e.g. return-authorization number, return shipping address).
- Return shipping costs are the responsibility of the Customer, unless the Product was damaged or incorrect upon arrival (see “Damaged or Incorrect Items” below).
- Once we receive and inspect the returned item and determine it meets the conditions above, we will ship a replacement Product of equal value (or if that is unavailable, a comparable alternative at our discretion), at no additional cost to you (excluding any difference in shipping charges if applicable).
- If the replacement Product is unavailable or you do not wish to accept a replacement, we will issue store credit for the value of the returned item – but we will not provide a cash refund under any circumstance.
6. Damaged or Incorrect Items
If your order arrives damaged or you receive an incorrect item, you must notify us within 48 hours of delivery.
Include your order number, a description of the issue, and photos of the damaged or incorrect item in your message.
We will then assess the issue and – at our discretion – offer a replacement, exchange, or store credit.
Exchanges for damaged or incorrect items are not subject to the 30-day “unused item” requirement.
7. Excluded Items
Some items may be marked at the time of sale as “Final Sale,” “Non-exchangeable,” or “Non-returnable.”
Such items are not eligible for exchange under any circumstance.
Examples may include (but are not limited to): custom or personalized products, clearance merchandise, intimate items (if applicable), or items clearly labeled as final sale.
8. Intellectual Property / Site Content
All content on this Site – including text, images, logos, graphics – is the property of FeatherStone Florals or its licensors, and is protected by copyright, trademark and other intellectual property laws.
You may not reproduce, distribute, or otherwise use any content from this Site without express written permission from us.
9. Limitation of Liability
To the fullest extent permitted by applicable law, FeatherStone Florals and its affiliates, employees, agents, suppliers, or partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site or purchase of Products – including (but not limited to) loss of profits, loss of data, or other intangible losses – even if we have been advised of the possibility of such damages.
Our total liability in connection with any product purchased through the Site is strictly limited to the purchase price you paid for that product.
10. Governing Law & Disputes
These Terms and Conditions shall be governed by and construed in accordance with the laws of Maryland, without regard to conflict of laws provisions.
Any disputes arising out of or relating to these Terms or your purchase must be filed in the state or federal courts located in Hagerstown, Maryland, and you consent to the exclusive jurisdiction of those courts.
11. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. When we do, we will revise the “Effective Date” at the top.
Your continued use of the Site or placing new orders after changes are posted constitutes acceptance of the updated Terms.
